TDOT Counsel Says Log Sheets Being Used by IDB / US Nitrogen

Subject: Re: Legal ROW width of TN SR 340 and TN SR 348...route of IDB / US N pipeline Mr. Bible: Thank you for your email. I received your correspondence this week when I returned to the office. My understanding is that TDOT’s maintenance division mowed the right-of-way along State Route 340 near your property several weeks ago pursuant to TDOT’s regular mowing activities and any mowing conducted was not related to the Industrial Development Board of the Town of Greene County and Greeneville, Tennessee’s (“IDB”) pipeline project which TDOT recently permitted along its rights-of-way of SR 340 and 348. As TDOT has iterated before, this is the IDB’s project and TDOT has only permitted the IDB’s ability to work within the State’s right-of-way. The IDB is responsible for verifying the rights-of-way in relation to its project.
Right-of-way lines are not uniform and can vary from property to property depending upon such factors as terrain and the deed history for each parcel of land. Additionally, the log sheets you reference below are not official documents or roadway plans and only offer general guidance as to where right-of-way lines are expected to be. With regard to your property, if you have concerns about future mowing activities being conducted within your property boundaries rather than the State’s right-of-way, TDOT is certainly happy to review its roadway plans and any deeds you may provide which may help to establish your particular property boundaries and then modify its mowing area if needed.
With respect to the remainder of your email, it appears that you are making a public records request for documents. Please be advised that TDOT can make available records in its possession such as roadway plans and any deeds pertaining to any projects along those routes in which land was acquired. If you are requesting deed information for every property owner along SR 340 and 348 in Greene County, the Greene County Register of Deeds and/or each individual property owner can provide you such information. Please let me know if you wish to review TDOT’s records mentioned above and we can schedule a mutually agreeable date for such inspection.

Please remember that when you are approached by anyone wanting to go over your property...that the map they show you supposedly representing the right of way across your property HAS NO LEGAL MEANING!

 

NEITHER DOES THE TDOT COMPUTER PRINT-OUT CALLED A  HIGHWAY LOG REPORT.

 

THE MAP AND LOG REPORT ARE ONLY APPROXIMATE! THE LOG REPORT SHEET WILL USUALLY SHOW A 40 FOOT RIGHT OF WAY...MEANING 20 FEET IN EACH DIRECTION FROM THE CENTER LINE OF THE ROAD.

 

IN REALITY THE LEGAL RIGHT OF WAY IN MOST CASES ON THESE TWO ROADS
IS ACTUALLY 30 FEET (15 FEET FROM THE CENTER LINE OF THE ROAD). JUST REMEMBER YOUR DEED IS THE FINAL AUTHORITY, UNLESS YOU HAVE SOLD LAND TO THE STATE ALONG YOUR ROAD.
